What Is California Proposition 65?
California Proposition 65 — formally known as the Safe Drinking Water and Toxic Enforcement Act of 1986 (California Health & Safety Code §§25249.5–25249.14) — is a right-to-know law requiring businesses to provide clear and reasonable warnings before knowingly or intentionally exposing consumers to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.
The law is administered by the California Office of Environmental Health Hazard Assessment (OEHHA), which publishes and maintains the official list of regulated chemicals. As of the date of this statement, the list contains over 900 chemicals and is updated at least once per year. You can view the current list at www.p65warnings.ca.gov.
Prop 65 applies to all businesses with 10 or more employees doing business in California — including online retailers selling to California residents.
Important distinction: A Prop 65 warning does not mean a product is unsafe or banned. It means that exposure to a listed chemical in that product may occur at a level that exceeds OEHHA’s safe harbor threshold. Many products with warnings are used safely by millions of people every day.
How Prop 65 Warnings Work
When a Warning Is Required
A Prop 65 warning is required when a consumer’s exposure to a listed chemical is anticipated to exceed OEHHA’s established safe harbor levels:
• No Significant Risk Level (NSRL) — for chemicals listed as carcinogens: the level of exposure that would result in no more than 1 excess case of cancer in 100,000 individuals exposed over a 70-year lifetime
• Maximum Allowable Dose Level (MADL) — for chemicals listed as reproductive toxicants: the level at which exposure would have no observable effect, with a 1,000-fold safety factor applied
A warning is not required solely because a listed chemical is present in a product — only when exposure is anticipated to exceed these thresholds. Businesses may conduct their own exposure analysis or rely on OEHHA’s established safe harbor levels.
Required Warning Format (2025 Amendments)
OEHHA approved significant amendments to Prop 65 warning requirements effective January 1, 2025. The table below summarizes the required elements for compliant product warnings:

Our Prop 65 Compliance Program
Product Page Warnings
Individual products on www.shoprolik.com that have been identified as potentially exposing consumers to one or more Prop 65 listed chemicals above safe harbor levels will include a compliant Prop 65 warning on the product page, prior to the completion of purchase. Warnings will include the required OEHHA symbol, signal word, at least one specific chemical name, and a link to www.p65warnings.ca.gov.
Where warnings are required, they are displayed on the product page and/or via a clearly marked WARNING link, consistent with OEHHA’s safe harbor methods for internet purchases.
Supplier Documentation
As part of our sourcing process, we request Prop 65 compliance documentation from our product suppliers, including:
• Certificates of compliance or safety data sheets (SDS) confirming chemical content relative to Prop 65 safe harbor thresholds
• Notification of any changes to product formulation or labeling that may affect Prop 65 warning requirements
• Updated warning language when suppliers revise their short-form warnings under the 2025 amendments
Upon receiving written notice from a manufacturer that a product warning has been updated, we will update the corresponding product page warning within 60 calendar days, consistent with our obligations under California Code of Regulations, Title 27, Section 25602(b)(2).
Our Product Philosophy
ROLIK® prioritizes sourcing products that are body-safe and formulated to minimize chemical exposure. Where possible, we work with suppliers who proactively test products against Prop 65 safe harbor levels and reformulate to avoid the need for warnings. Where a Prop 65 warning is required, we display it transparently — we do not omit warnings in favor of sales.
2025 Amendments & Compliance Timeline
The OEHHA amendments approved November 26, 2024 and effective January 1, 2025 represent the most significant update to Prop 65 warning requirements since 2018. The following timeline summarizes the key milestones and what they mean for ROLIK®:

Our commitment: ROLIK® is actively auditing its product catalog and supplier documentation to transition to compliant new short-form warning language ahead of the January 1, 2028 mandatory deadline. We are not waiting until the last moment.
Enforcement & Penalties
Prop 65 is enforced by the California Attorney General’s office, district attorneys, city attorneys (in cities with populations over 750,000), and — most commonly — private enforcers. Private plaintiff attorneys routinely send “60-day notices” to businesses as a precursor to civil suit.
Penalties for failing to provide a required Prop 65 warning can reach $2,500 per violation per day. Given this enforcement environment, ROLIK® takes its Prop 65 obligations seriously and treats compliance as an active, ongoing program rather than a one-time checkbox.
